Unit Perundangan

Introduction

Unit Perundangan memainkan peranan penting untuk menasihati Jabatan dalam perkara yang melibatkan isu perundangan dan merangkumi skop kerja yang berikut:

  • Provide legal advice on occupational safety and health issues to the Department in accordance with the provisions of the Federal Constitution and relevant written laws;
  • Peruse agreement and memorandums of understanding documents which are to be signed by the Department as well as any other instruments that contain legal elements to ensure that all documents are in order in terms of law;
  • Monitor, manage, supervise and co-ordinate prosecution cases nationwide involving the Department;
  • Conduct civil litigation for lawsuits involving the Department and issue notices of claim against parties liable for outstanding workplace or machinery registration fees;
  • Gazette the appointment of Department officers, exemption Orders, or any Orders or Regulations made by the Department;
  • Review proposed amendments to Acts and subsidiary legislation as well as drafted the new subsidiary laws; and
  • Collaborate with other Divisions to provide legal training and advice.
  • Attend Department and Ministry level meetings regarding issues involving legislation.
  • Hold discussions with state offices regarding investigation papers pertaining to any non-compliance by companies or individuals under any Act or subsidiary legislation.
  • Grant permission to prosecute of any non-compliance that has been committed.
  • Organize training sessions or lectures related to legal matters
  • Provide advice on occupational safety and health issues in writing or orally to the Department.
  • Submit daily reports to the Attorney General's Chambers regarding activities in the Department.
