Office of Legal Counsel
Introduction
The Legal Division plays an important role in advising the Department on matters involving legal issues and includes the following scope of work:
- Provide legal advice on occupational safety and health issues to the Department in accordance with the provisions of the Federal Constitution and relevant written laws;
- Peruse agreement and memorandums of understanding documents which are to be signed by the Department as well as any other instruments that contain legal elements to ensure that all documents are in order in terms of law;
- Monitor, manage, supervise and co-ordinate prosecution cases nationwide involving the Department;
- Conduct civil litigation for lawsuits involving the Department and issue notices of claim against parties liable for outstanding workplace or machinery registration fees;
- Gazette the appointment of Department officers, exemption Orders, or any Orders or Regulations made by the Department;
- Review proposed amendments to Acts and subsidiary legislation as well as drafted the new subsidiary laws; and
- Collaborate with other Divisions to provide legal training and advice.
