Background

The National Council for Occupational Safety and Health (MNKKP) under the Ministry of Human Resources is the highest body responsible for determining the direction and national policy regarding occupational safety and health in Malaysia. It was established in 1995 under Section 8 of the Occupational Health and Safety Act 1994 (Act 514).

The main objective of the establishment of MNKKP is the government's continuous efforts to ensure that the safety, health and welfare of workers in the workplace are guaranteed. In this regard, MNKKP always strives to improve the level of occupational safety and health in making safe and healthy work practices part of Malaysian culture. This effort is based on a tripartite alliance (government - employers - employees) towards enculturing these practices.

The MNKKP consists of no less than twenty-two and no more than twenty-five members appointed by the Minister of Human Resources. The DOSH officer will act as the secretariat of the Council.

Members of the Council shall hold office for a period of three years or for such shorter period as may be determined by the Minister and shall be eligible for reappointment for a maximum of two terms.

  • (a) Five (5) people from organizations representing employers;
  • (b) Five (5) people from organizations representing employees;
  • (c) Secretary-General of the Ministry of Human Resources;
  • (d) Director General of DOSH;
  • (e) Five (5) Government representatives, consisting of—
  • (i) Director General of Health Malaysia; and
  • (ii) representatives from the Ministry or Department whose responsibilities relate to occupational safety and health,
  • (f) Executive Director of the National Institute of Occupational Safety and Health;
  • (g) Chief Executive Officer of the Social Security Organization; and
  • (h) Three (3) or more persons, at least one of whom shall be a woman, from an organization or professional body whose members' activities are related to occupational safety and health.

The Minister shall appoint the Chairman and Deputy Chairman of the Council from among the persons mentioned above except the persons mentioned in paragraph (d)

The Director General of DOSH, who is a member of the Council, shall be the Secretary to the Council.
